Governing your access to and use of LIBILcheck.com and all related services

Last Updated

24th August 2026

These Terms & Conditions ("Terms") govern your access to and use of LIBILcheck.com, including the website, products, reports, tools and related services made available through the website (collectively, the "Platform").

LIBILcheck.com is operated by LQ Global Services Private Limited, a company incorporated under the laws of India ("LIBIL", "Company", "we", "us" or "our").

By accessing the Platform, creating an account, purchasing a check, submitting information, clicking "I Agree", or otherwise using any service offered through the Platform, you ("User", "you" or "your") acknowledge that you have read, understood and agreed to these Terms.

If you do not agree with these Terms, you must not access or use the Platform.

These Terms should be read together with our Privacy Policy.

Section 01

Definitions

1.1 "Platform"

"Platform" means LIBILcheck.com, its website, applications, interfaces, technology, databases, systems, tools and related services made available by the Company.

1.2 "User"

"User" means any individual who accesses or uses the Platform or purchases, initiates or requests a Check.

1.3 "Subject"

"Subject" means the individual whose name, identifying information or other details are submitted by the User for the purpose of conducting a Check.

1.4 "Check"

"Check" means a criminal-record or related record search initiated by the User through the Platform using information submitted by the User and information available to the Company from permitted sources.

1.5 "Report"

"Report" means the result or output generated by the Platform in connection with a Check.

1.6 "Information"

"Information" includes personal information, identifying information, records, documents, data and other information submitted by the User or obtained from sources used in connection with a Check.

Section 02

About the Service

2.1

LIBIL provides technology-enabled access to information relating to criminal records and other legally accessible records for lawful and legitimate purposes.

2.2

The Platform is intended to help Users make better-informed decisions. A Report is an information and decision-support tool and is not a certification, guarantee or determination of a person's character, integrity, suitability, innocence or guilt.

2.3

LIBIL does not act as a police authority, court, investigative agency, private detective agency, law-enforcement agency or legal adviser by providing the Platform.

2.4

LIBIL does not determine whether a person is suitable for employment, domestic work, tenancy, caregiving, driving, matrimonial relationships or any other purpose. That decision remains solely with the User.

2.5

A Check may identify information that appears relevant to the Subject based on the information submitted and the sources available to LIBIL. The availability of a record does not by itself establish that the Subject committed an offence or is otherwise responsible for the underlying matter.

Section 03

Important Notice About Reports

Important

A LIBIL Report should not be treated as conclusive proof of criminal conduct, guilt, character or future behaviour.

3.2

Information contained in a Report may be affected by the quality, completeness, accuracy, availability and timeliness of the underlying sources.

3.3

A Report may not contain every record relating to a Subject. The absence of a record in a Report does not mean that the Subject has never been involved in any criminal complaint, FIR, investigation, proceeding or other legal matter.

3.4

Similarly, the presence of a record does not necessarily mean that the Subject is guilty of an offence. Criminal proceedings may have different outcomes, including acquittal, discharge, quashing, closure or other outcomes.

3.5

Where appropriate, Users should independently verify material information and consider obtaining additional documentation or professional assistance before making an important decision.

3.6

LIBIL does not guarantee that a Report will identify every record relating to a Subject or that every record identified will remain current after the date on which the Check is conducted.

Section 04

Identity Matching and Accuracy

4.1

The accuracy and relevance of a Check depends, among other things, on the information supplied by the User.

4.2

Names, addresses and other identifying information may be shared by multiple individuals. Accordingly, a record identified through a name or other identifier may not necessarily relate to the Subject intended by the User.

4.3

The User is responsible for providing sufficiently accurate and relevant information to enable the Check to be conducted.

4.4

LIBIL does not guarantee that every record identified through the Platform belongs to the Subject submitted by the User.

4.5

Users must not rely solely on a Report to make a decision that could materially affect another person's employment, housing, personal relationships, reputation, safety or other rights without appropriate independent verification.

Section 05

Consent and Lawful Use

5.1

Before submitting personal information relating to a Subject or initiating a Check, the User must have a lawful basis and all permissions, notices or consents required under applicable law.

5.2

Where consent is required, the User represents and warrants that the User has obtained such consent from the Subject before submitting the Subject's information to the Platform.

5.3

The User is responsible for informing the Subject, where required by applicable law, that:

  • their information is being submitted for a Check;
  • information may be processed for the purpose of conducting the Check;
  • a Report may be generated based on the Check; and
  • the Report may be made available to the User who initiated the Check.

5.4

The User must not submit another person's information without a lawful basis or use the Platform to obtain information for an unlawful, abusive or illegitimate purpose.

5.5

LIBIL may rely on the User's representations regarding the authority, lawful basis and permissions under which information is submitted. LIBIL may request additional information or evidence where reasonably necessary.

5.6

Nothing in these Terms prevents LIBIL from taking reasonable steps to comply with applicable data-protection, privacy or other legal requirements.

Section 06

User Representations and Warranties

By using the Platform, the User represents, warrants and undertakes that:

  • a. the User is legally capable of entering into these Terms;
  • b. the information submitted by the User is accurate and not knowingly false, misleading or fabricated;
  • c. the User has a lawful purpose for conducting the Check;
  • d. the User has obtained any consent, authorization or other legal basis required to conduct the Check;
  • e. the User will not use the Platform for harassment, intimidation, stalking, discrimination, retaliation, defamation or any unlawful purpose;
  • f. the User will not knowingly attempt to identify, investigate or obtain information about a person for an illegitimate or prohibited purpose;
  • g. the User will not impersonate another person or misrepresent their identity;
  • h. the User will comply with all applicable laws and regulations; and
  • i. the User will use any Report responsibly and only for the purpose for which the Check was legitimately initiated.
Section 07

Prohibited Uses

You must not use the Platform or any Report:

  • a. for any unlawful purpose;
  • b. to harass, threaten, stalk, intimidate or defame any individual;
  • c. to discriminate unlawfully against any individual;
  • d. to facilitate fraud, identity theft or impersonation;
  • e. to obtain information about another person without an appropriate lawful basis;
  • f. to publish, sell, redistribute or commercially exploit a Report without our prior written permission;
  • g. to represent a Report as an official police, court, government or law-enforcement certificate;
  • h. to represent that LIBIL has certified, cleared, approved or endorsed the Subject;
  • i. to make a false allegation that a Subject has committed a crime based solely on the contents of a Report;
  • j. to reverse engineer, scrape, copy or systematically extract data from the Platform;
  • k. to circumvent security, access controls or technical restrictions;
  • l. to upload malicious code, viruses or other harmful material; or
  • m. to use the Platform in a manner that may damage, disable, overburden or impair the Platform or interfere with another person's use of the Platform.
Section 08

Use of Reports

8.1

Reports are provided for the User's personal and lawful use and should be treated as confidential.

8.2

The User is responsible for maintaining the confidentiality of any Report obtained through the Platform.

8.3

The User must not publicly post, publish, circulate or otherwise disclose a Report or personal information contained in it except where legally permitted or necessary for the legitimate purpose for which the Check was conducted.

8.4

The User must not alter, manipulate or selectively reproduce a Report in a manner that materially misrepresents its contents.

8.5

If the User shares a Report with another person or organization, the User is responsible for ensuring that such disclosure is lawful and appropriate.

Section 09

Information Sources and Data Quality

9.1

LIBIL may obtain or process information from publicly available, legally accessible, licensed, third-party or other permitted sources.

9.2

The Company takes reasonable steps to provide useful and reliable information. However, LIBIL does not warrant that all information made available through the Platform will always be:

  • complete;
  • accurate;
  • current;
  • error-free;
  • available without interruption; or
  • suitable for every purpose.

9.3

Information obtained from third-party or public sources may contain errors, omissions, delays or inconsistencies.

9.4

The Company may modify, update, add, remove or discontinue sources, features, checks, databases or portions of the Platform at any time.

Section 10

No Guarantee of Future Conduct

A Report reflects information available through the Check at or around the time it is conducted.

A Report cannot predict or guarantee a person's future conduct.

A person who has no record identified through a Check may nevertheless engage in misconduct in the future, and a person with a record may not necessarily pose a risk to the User.

The User remains solely responsible for evaluating the circumstances and making their own decision.

Section 11

Payments, Fees and Refunds

11.1

The fees applicable to a Check will be displayed on the Platform at the time of purchase.

11.2

The User agrees to pay all applicable fees and taxes associated with the selected service.

11.3

Once a Check has been initiated and processing has commenced, the applicable fee may be non-refundable, except where otherwise required by applicable law or expressly provided under our refund policy.

11.4

Where a Check cannot be completed because of a technical failure attributable to LIBIL, or for another reason for which a refund is expressly approved by LIBIL, the Company may, at its discretion, provide a replacement Check, credit or refund.

11.5

A User's dissatisfaction with the contents or outcome of a Report, including the absence or presence of a particular record, will not by itself constitute a basis for a refund.

Section 12

Privacy and Personal Information

12.1

The collection, use, storage, disclosure and other processing of personal information through the Platform is governed by our Privacy Policy, as amended from time to time.

12.2

By using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the processing of information in accordance with it, to the extent required under applicable law.

12.3

The Company will process personal information only for legitimate purposes and in accordance with applicable data-protection and privacy laws.

12.4

The Company may retain information for the period reasonably necessary to provide the services, comply with legal obligations, maintain security, prevent fraud, resolve disputes, enforce these Terms or otherwise as permitted by applicable law.

12.5

Information may be deleted, anonymised or otherwise handled in accordance with the Company's applicable retention policies and legal obligations.

Section 13

Data Security

LIBIL takes reasonable technical and organizational measures designed to protect information against unauthorized access, alteration, disclosure or destruction.

However, no internet-based service or electronic transmission can be guaranteed to be completely secure.

To the maximum extent permitted by applicable law, LIBIL will not be responsible for security incidents arising from circumstances beyond its reasonable control, including unauthorized access caused by the User's failure to maintain account credentials or device security.

Section 14

Intellectual Property

14.1

All rights, title and interest in the Platform, including its software, technology, design, interface, branding, trademarks, logos, databases, compilation, reports, formats and other proprietary materials, belong to LIBIL, its affiliates or applicable licensors, except for third-party or publicly available content.

14.2

Nothing in these Terms grants the User ownership of the Platform or any intellectual property belonging to LIBIL.

14.3

Subject to these Terms, LIBIL grants the User a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended lawful purpose.

14.4

The User must not copy, reproduce, modify, distribute, reverse engineer, scrape, sell, license or commercially exploit any proprietary component of the Platform without our prior written permission.

Section 15

Third-Party Services and Sources

The Platform may depend upon or contain information, services, links or technology provided by third parties.

LIBIL does not control all third-party services or sources and does not guarantee their availability, accuracy, completeness or continued operation.

The use of third-party services may also be subject to the terms and privacy policies of those third parties.

Section 16

Suspension and Termination

LIBIL may suspend, restrict or terminate your access to the Platform, with or without prior notice where reasonably necessary, if:

  • a. you breach these Terms;
  • b. you provide false, misleading or fraudulent information;
  • c. your use creates legal, regulatory, security or reputational risk;
  • d. LIBIL reasonably suspects unlawful or abusive use;
  • e. suspension is required to comply with applicable law or an order of a competent authority; or
  • f. the Platform or a particular service is discontinued.

Termination or suspension will not affect rights or obligations that accrued before the effective date of termination.

Section 17

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Platform and Reports are provided on an "as available" and "as is" basis.

LIBIL does not warrant that:

  • a. the Platform will always be available or uninterrupted;
  • b. the Platform will be error-free;
  • c. every record relating to a Subject will be identified;
  • d. every record identified will be accurate or complete;
  • e. a Report will be suitable for a particular decision or purpose; or
  • f. the information contained in a Report will predict a person's future conduct.

The User understands and agrees that a Report is an information and decision-support tool and should not be treated as a substitute for independent verification, professional advice, police verification or any other verification process that may be appropriate in the circumstances.

Section 18

Limitation of Liability

To the maximum extent permitted by applicable law, LIBIL, its affiliates, directors, officers, employees, agents, licensors and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, including loss of profits, revenue, business opportunity, reputation, goodwill or data, arising out of or relating to the use of, or inability to use, the Platform or any Report.

LIBIL shall not be responsible for:

  • a. decisions made by the User based on a Report;
  • b. errors, omissions or delays originating from third-party or public sources;
  • c. mistaken identity or incorrect matching resulting from insufficient or inaccurate information supplied by the User;
  • d. the future conduct of a Subject;
  • e. unlawful or unauthorized use of a Report by the User or any third party;
  • f. interruption, suspension or unavailability of the Platform arising from circumstances beyond LIBIL's reasonable control; or
  • g. any loss arising from the User's failure to independently verify information where such verification was reasonably necessary.

To the maximum extent permitted by applicable law, LIBIL's total aggregate liability arising out of or relating to a particular Check or transaction shall not exceed the amount actually paid by the User for that Check.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

Section 19

Indemnification

You agree to indemnify and hold harmless LIBIL, LQ Global Services Private Limited, its affiliates, directors, officers, employees, agents, contractors, licensors and service providers from and against claims, losses, liabilities, damages, costs and reasonable expenses arising out of or relating to:

  • a. your breach of these Terms;
  • b. your failure to obtain any consent, authorization or lawful basis required for a Check;
  • c. your misuse of the Platform or a Report;
  • d. your unlawful disclosure or distribution of information obtained through the Platform;
  • e. information submitted by you that is false, misleading or unauthorized;
  • f. your violation of any applicable law or third-party rights; or
  • g. any claim arising from a decision or action taken by you using a Report contrary to these Terms.
Section 20

User Responsibility for Decisions

The User acknowledges that LIBIL does not make decisions on behalf of the User.

Whether to hire, engage, retain, accommodate, contract with, associate with or otherwise interact with a Subject remains entirely the User's decision and responsibility.

Where a decision may materially affect another person, the User should consider the context of the information, provide appropriate opportunity for clarification where appropriate, and comply with all applicable laws before taking action.

Section 21

Changes to These Terms

LIBIL may modify these Terms from time to time to reflect changes in the Platform, applicable law, business practices or other circumstances.

The updated version will be made available on the Platform and will indicate the date on which it was last updated.

Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

If you do not agree with the revised Terms, you must stop using the Platform.

Section 22

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the applicable dispute-resolution mechanism provided by law.

Subject to the foregoing and unless otherwise required by applicable law, the courts having jurisdiction at New Delhi, India shall have jurisdiction over disputes arising from these Terms.

Section 23

Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Section 24

Waiver

The failure of LIBIL to enforce any provision of these Terms at any time shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

Section 25

Entire Agreement

These Terms, together with the Privacy Policy, applicable Refund Policy and any other terms expressly incorporated by reference, constitute the agreement between you and LIBIL in relation to your use of the Platform.

If there is a conflict between these Terms and a specific additional term applicable to a particular service, the specific additional term shall prevail to the extent of that conflict.
